As noted before, 06/01/2009 was one episode in two parts. 09/01/2009 was one episode in two parts. So following TVRage (which is right for once) and the logical order of one episode per day, this is episode 9.
The break between each part of live evictions is all part of a single event (the event being the live eviction), giving the housemate time to get ready.
But here we are mislabelling like the rest because its cool to conform! Even if it's something blatantly stupid and wrong.
